1.देश में ’बहुजन समाज’ में से ख़ासकर एससी, एसटी व ओबीसी वर्गों के लिये आरक्षण ’सामाजिक परिवर्तन व आर्थिक मुक्ति’ अर्थात् हमेशा से इनके आत्म-सम्मान की ज़िन्दगी से जुड़ा अति-महत्वपूर्ण व अत्यन्त संवेदनशील मामला है और जाति के आधार पर सदियों से यहाँ तोड़े, सताये व पछाड़े गये एससी व एसटी समाज के लिये तो यह अत्यन्त ज़रूरी मामला भी विशेषकर तब बन जाता है जब जातिवादी द्वेष, शोषण, प्रताड़ना, अन्याय-अत्याचार कम होने का नाम ना ले, और इसीलिये इसमें क्रीमी लेयर की बात करना अनुचित ही नहीं बल्कि परमपूज्य बाबा साहेब डा. भीमराव अम्बेडकर के मानवतावादी संविधान के पवित्र उद्देश्यों के भी विरुद्ध है, हालाँकि किसी को भी इसकी अनदेखी नहीं करनी चाहिये बल्कि सभी को देश व जनहित के मद्देनज़र अपनी पूूरी ईमानदारी व निष्ठा के साथ इस पर अमल भी ज़रूर करना चाहिये।
2.जबकि इस बारे में आरएसएस प्रमुख का अभी हाल में फिर से यह कहना कि, ’आरक्षण का जानबूझकर राजनीतिकरण किया गया है जिससे समाज में कड़वाहट भरी है तथा आरक्षण के लाभार्तियों को स्वेच्छा से इसका लाभ छोड़ देना चाहिये’, वास्तव में यह इनकी ऐसी जातिवादी सोच है जिससे संकीर्ण राजनीतिक स्वार्थ की पूर्ति तो हो सकती है, किन्तु इससे संवैधानिक उद्देश्यों की अवहेलना होती है, क्योंकि आरक्षण मूलतः सदियों से जातिवादी व्यवस्था के शिकार करोड़ों शोषित-पीड़ित, उपेक्षित व तिरस्कृत लोगों को मानवीय आधार पर समता व समानता का संवैधानिक व कानूनी अधिकार देना है, और जिसे आर्थिक उन्नति से कतई भी नहीं आँका जा सकता है, क्योंकि जातिवाद का दंश जीवन के हर पहलू में उन्हें डसता ही रहता है और जो क्रम अभी भी हर स्तर पर लगातार जारी है, यह आरएसएस से ज़्यादा भला कौन जानता है?
3.इतना ही नहीं बल्कि केन्द्र में अभी तक रही सभी सरकारें भी इस कड़वी ज़मीनी वास्तविकता को भलीभाँति जानती और समझती भी हैं और इसीलिये अगर वर्तमान सरकार अपने वाजिब तर्कों के आधार पर इसकी प्रभावी व समुचित पैरवी करके एससी व एसटी समाज को क्रीमी लेयर से दूर रखने हेतु अपना पक्ष अदालत से मनवा लेती है तो यह पूर्णतः उचित व संवैधानिक होगा। वैसे अक्सर यही देखा गया है कि सरकारों के लचर रवैये व अच्छी कानूनी पैरवी के अभाव में ही अदालतें ’सामाजिक परिवर्तन’(Social Transformation) आदि के मामलों में सही से न्याय नहीं कर पाती हैं।
4.इस बारे में आरएसएस से भी यही कहना है कि वह परमपूज्य बाबा साहेब डा. भीमराव अम्बेडकर के मानवतावादी एवं कल्याणकारी संविधान को पूरा-पूरा आदर-सम्मान देते हुये आरक्षण को लेकर राजनीति करना छोड़ दे और साथ ही आरक्षण में किसी भी प्रकार की छेड़छाड़ की वकालत बंद करके देश में ’समतामूलक समाज व्यवस्था’ (Equalitarian Social order) की स्थापना के संवैधानिक दायित्व/उद्देश्यों की पूर्ति में पूरी तरह से सहयोग करे तो यह बेहतर होगा, यही वक्त की ज़रूरत व समय की माँग भी है।
