Section 498A was drafted specifically for wives, but the Supreme Court has now ruled that a woman in a live-in relationship can also file a case under Section 498A. Section 498A is such a ridiculous law that, for the past 42 years, the courts have continued to give it bizarre and illogical interpretations.

This is an utterly terrible, absurd, and nonsensical ruling, and women are likely to misuse it extensively.

Supreme Court has clarified:
A wife living in adultery can be denied interim maintenance under Section 125 CrPC.

But the husband has to show clear, ex facie evidence. Not just allegations. Not after years of trial.

If the proof is strong on the face of it, the bar applies even at the interim stage.

No more automatic maintenance while the adultery claim is kept pending forever.

Law is clear. Adultery disentitles.

Now courts have been told to look at the evidence properly instead of delaying it.

This is a good judgment.

The wife initiated the following legal proceedings against the husband:-

1. Dowry case (the husband was acquitted).
2. Three Domestic Violence (DV) complaints (all three were dismissed).
3. Proceedings under Section 125 CrPC (remained inconclusive).
4. A petition before the High Court seeking ₹1,500,000 in maintenance.

The husband legal actions:-

1. Filed a divorce petition in 2013 (the wife took ₹750,000 in the name of divorce).

2. Filed another divorce petition in 2014, but it was later withdrawn.

3. Filed yet another divorce petition. It is in this case that the wife filed a petition before the High Court seeking ₹1,500,000 in maintenance.

Facts :-

1. During her cross-examination, the wife admitted that her marriage to the husband had never been consummated.

2. In her statements, the wife also claimed that the husband was of unsound mind.

3. In 2013, the wife took ₹750,000 from the husband in the name of divorce but never granted him a divorce.

The court gave due weight to these facts and dismissed the wife's appeal, observing that she could undergo her cancer treatment under the Ayushman scheme. The court further held that a husband of unsound mind could not be directed to pay maintenance, especially since that was the wife's own claim.
