The Supreme Court’s decision to protect the Indian Child Welfare Act is truly historic.
Over the past 6 months alone, lawmakers across several states passed ICWA laws, just to ensure Native children could stay with Native families in child welfare cases.
In #Brackeen the plaintiffs tried to argue that #ICWA was unconstitutional for 3 big reasons. First, that it was racial discrimination against the non-Native foster parents who wanted to adopt #Native kids.
On this ground #SCOTUS ruled they don’t have standing.
For the unfamiliar, the Doctrine of Discovery was a series of papal bulls that said Christian Nations became the rightful owner of any land they found occupied by non-Christian people. Europeans used it to colonize most of the earth. It’s never been rescinded.
