@TheOmahaShrike@Nuancefactcheck@lear_donna97997@LegalNewsline Victims of sexual abuse are allowed to come forward. They are just not allowed to come forward indefinitely! If you’re not willing to advocate for yourself, you give up your rights. That is the firm rationale behind statutes of limitation. And this case appears to be a civil case
@TheOmahaShrike@Nuancefactcheck@lear_donna97997@LegalNewsline Of course not, and that is always a problem in old murder cases. You have to hope that there is some preserved forensic evidence, witnesses that are not dead, etc. I think the rationale is that murder is viewed as the most heinous act you can commit
@lear_donna97997@LegalNewsline Also, this appears to be a civil suit, not a criminal prosecution. So she is trying to get MONEY damages. Civil suits always have statutes of limitation.
@vanderwel_nancy@lear_donna97997@LegalNewsline Bullshit! Not having a statute of limitations, makes it too difficult for any person to defend themselves from false claims. Statutes of limitation protect everyone, allowing witnesses to be found, evidence to be found, etc. You can’t “sleep on your rights“ and still have justice
@lear_donna97997@LegalNewsline The same reason there are statute of limitations for everything. Your inaction should not allow a stale claim to be brought. It is too difficult to defend a claim 20 years after the fact! I firmly believe in statute of limitations (I’m a retired)
@rmkcleopup@SquidbillyCPO1@MatrixMysteries@Sober297 Where is personal responsibility and accountability? Why aren’t the father(s) paying child support? Why are we supporting a 300 pound woman who claims that she will “starve“ without EBT? If you can’t make ends meet, get a different job.
@realUncleWoWo@Letsgeauxtrave1@CollinRugg And it is not limited to Black people. My MIL was a home birth in the 20s, and her family did not apply for the birth certificate. She later got a passport using baptismal and other records. It was a pain in the butt, but she managed it
@Letsgeauxtrave1@CollinRugg He was probably born at home. My husband’s mother was born at home in the 20s, and you had to take active steps (which her parents did not do) to get a birth certificate. She had to get baptismal records to get her passport. Despite their attempts to race bait, race is irrelevant
@tonyc920@nettermike Nope, she needs to go to jail. As well as losing her license, and state benefits. As a judge, she should be held to a higher standard.
