The court decided that the document was valid and that the court has no power to issue a writ of mandamus because it is unconstitutional. By doing this they set up judicial review, the power given to the courts to decide is an action is unconstitutional. #jrobgov
John Adams had only a day left in his presidency. He signed and sealed the document that would allow William Marbury to be the Justice of the Peace. The current Secretary of State did not deliver the documents until after Thomas Jefferson was President.
Jefferson told James Madison, the Secretary of State, to not deliver the documents. Marbury applied to the Supreme Court for a writ of mandamus. The Supreme Court had to decide if the document was legal, and if the court had the power to issue a writ of mandamus.
