A democratic state does not allow public opinion to determine its decision regarding a political party. Whether a party, its ideology and political activities are allowed to operate are factors entirely up to the state's discretion. This decision comes from jurisprudence, political philosophy and the concept of fundamental justice of a state. When it comes to taking a decision on the banning of a political party, certain factors are completely irrelevant: public opinion, views of other political parties and the issue of voter turnout. The state must evaluate if the ideology and activities of the party align with the fundamental values of the Constitution. In case there is incompatibility, the state may decide to ban the party. What the state should not care about in this scenario is the opinions of the public or other entities. At its core, the responsibility of the state is to do its best to protect the country's democratic and fair structure. If the Awami League follows a fascist ideology and resorts to terrorism as part of its political strategy, it is irrelevant if the BNP or Jamaat wants to allow it to remain active politically or not. If a party does not align with the foundation of the state, it cannot remain active. On the other hand, if the Awami League operates following democratic ideals, it cannot be banned, regardless of what the BNP or Jamaat says. Public opinion has nothing to do with this matter, either. If the Awami League truly operates like a fascist-terrorist organisation, support from another political party cannot help it come clean or save it from being banned. So, if the state is honest, steadfast on the path of justice, and follows the Constitution, it has to judge whether the Awami League is in harmony with the state and not indulging in unconstitutional activities. Then the state will take a decision whether the party will be allowed to remain active in politics or not. No decision should be made on the basis of any Facebook post, a TV talk show or the “consensus of some political parties”. In a landmark decision in the history of Bangladesh, the Awami League has now been banned. This is a decision belonging to the state. This is a decision belonging to history. This is a decision belonging to justice. The policies, ideals and values of the Awami League are against the basic principles that guide Bangladesh as a state. A party like this has no business practising politics in the country.
