Club Legend Rongai has been ordered to pay Ksh. 500,000 to Mutheu Mutuku for posting her image on their social media pages for commercial gain without her express consent. Although Mutuku requested the image be removed as early as November 2022, the club ignored her requests for over a year, leading the Data Commissioner to find they violated her rights to privacy and data erasure under the Data Protection Act.

The ODPC found the respondent liable because they could not provide proof of consent or a legal basis for processing the complainant's data. This is warming to clubs,YOU must strictly adhere to the right of a data subject to withdraw consent at any time and must act without undue delay when requested to pull down personal data.
