Allow me to mansplain 😂 The attorneys didn’t secretly question the jurors. The foreperson sent the judge a note identifying one juror and describing the impasse, apparently revealing the numerical split. Once the note was discussed in open court, the attorneys and press knew about it. The judge then specifically told the jury not to reveal vote counts in future notes.

The defense also wasn’t legally arguing, “He voted guilty, so throw him out.” A juror cannot be removed merely for disagreeing. The defense alleged that he acknowledged reasonable doubt but refused to apply the judge’s instructions—potential juror misconduct. The judge found insufficient grounds to remove him, kept him on the jury, and the continuing deadlock resulted in a mistrial.
