Several Mak'gora to the death have occurred since it was "re-invented" to be non-lethal. And a contest which has its rules agreed upon is often likely to have a set of "traditional" rules.

In canon, the only inherent rule of a Mak'gora is that the rules are agreed upon by the combatants.

We don't know. The existence of the Retcon ability seems to imply to some degree the former, but then Egbert acquiring said ability is itself a part of the alpha timeline.
Because of the metanarrative underpinnings of HS, we can assume both are true!
