“The evidence concerning the Vaccine Injury Support Program raises similar concerns. The Plaintiff's evidence is that the Program has been characterized by extraordinary delay, administrative dysfunction, uncertainty, and a failure to provide timely and meaningful assistance to many of the very individuals it was created to support.
These were not incidental systems.
They were the Defendants' chosen mechanisms for monitoring, assessing, reporting, and responding to the very harms they acknowledged could occur.
If those systems ceased providing meaningful information, ceased functioning as represented, or failed to provide timely and effective support despite ongoing statutory responsibilities relating to health monitoring and injury prevention, that alleged failure goes directly to the standard of care, the adequacy of the Defendants' response to foreseeable harm, and the common issues proposed in this action.
Further, the Defendants did far more than simply make public health recommendations. The evidence before the Court demonstrates a coordinated, state-directed communications, marketing, and advertising campaign of unprecedented scale, undertaken for the admitted purpose of influencing behaviour and increasing vaccine uptake.”
