EXCLUSIVE: Internal records reveal Washington’s “millionaire’s tax” may be about more than just taxing high earners.

Emails obtained by The Center Square show that some lawmakers and AG staff discussed using the law to force the state Supreme Court to reconsider a nearly 100-year-old ruling that blocks a broader income tax.

That ruling defines income as property, limiting how it can be taxed.

If overturned, it could pave the way for a progressive income tax on all Washingtonians, not just millionaires.

The 9.9% tax is already facing legal challenges ahead of its planned 2028 rollout.

Since its passage by voter initiative in 1972, the Washington Public Records Act (PRA) has been broadly interpreted by courts in order to promote transparency and accountability in government. The PRA is intended to ensure broad public access to government documents, reinforcing the principle that the public has a right to know how government decisions are made, and taxpayer money is spent.

However, a ruling last week by the Washington Supreme Court on an appeal from the Citizen Action Defense Fund marked a shift in this philosophy. The Court held that documents related to the deliberative process of collective bargaining negotiations between public sector unions and government entities are exempt from disclosure under the PRA — at least until after those agreements are approved by the legislature and signed into law by the governor. This opens the court up to the criticism that it is protecting special interests--state employee unions--from transparency as their contracts are negotiated by the Governors office.

HB 1334 was honest enough to have “property tax” in the title. But HB 2049 is titled "Investing in the state's paramount duty to fund K-12 education and build strong and safe communities.” Not a word about taxes, and yet… this is still about increasing your taxes faster, without your consent. And there’s new language to specifically let schools ask for more in their levies.

It's well past time for Legislative Democrats to realize that the vast majority of Republicans, Democrats, and Independents DO NOT want property tax or rent increases. People are already being priced out of their homes.
