Most APS I see say "Seller shall fix 'x' before closing" - period. Why not add to that and say, if not, purchase price will be reduced by 'y' or, alternatively, there will be a holdback of 'z'. Basically add a consequence if the seller doesn't perform the fix.
Tip: Assuming hot water tank rentals in an APS should not be done without confirming the existing contract terms. What you thought was $20/month is actually $50/month, with a $5k fee to buy out the contract. And oh ya, there is a lien on title. #ottawa#realestate#lawyer
