The perfect Halloween, birthday or Christmas present!
Noticed a vacancy for the senior costs judge on the Jac website. The new SCJ will be my third since I started which sadly reflects my age. My first ever assessment was before the present one (before he was SCJ) in Clifford's inn on a bill of £4k...big shoes to fill
@kerry_underwood @paulistapark Supreme court are unlikely to hear it in my view. They rarely muddy their hands with costs, so it will likely stand (until the act is reformed which might happen by 2074 if we're lucky!)
...who serves replies late can't be in a worse position than those who do not serve them at all). Had the PP specifically asked for replies or set out key issues where they needed clarification I suspect the situation might have been different.
Recently the senior costs judge (ex tempore decision) considered whether serving very late replies was a factor to take into account under 36.17(5)(c)and (d).He concluded it was not relevant, due to the voluntary nature of replies (& accepted that it can't be right that a party..
@BarbaraRich_law Also, all lawyers know that judges (even the court of appeal!) Can get things wrong-i have no idea whether that's true here or not- but the public seem very quick to jump to the conclusion that there is some conspiracy work when no evidence exists.
@BarbaraRich_law I don't understand why she is crowdfunding for inter partes costs if she has ATE? Unless the ATE did not cover the appeal? That needs to be clarified asap.
New edition of the indispensable Friston on Costs coming soon from @Mark_Friston, will also include a digital pack and ebook option which will mean I no longer have to try and photocopy key pages for hearings (usually missing the key text!) https://t.co/ftGWM9ajpw
Can one judge make a costs order and a different judge undertake the summary assessment? No says the court of appeal in case handed down today, where I acted for the appellant. The judge making the order must conduct the summary assessment.

Those of us who visit the SCCO regularly have a head start on calling Masters "judge" in court as we've had to get out of the habit of addressing them as Master for some time now. All appear forgiving of the occasional slip...Personally I think "Master" is outdated.
