A big questions remains. What qualifies as "knowing" or "intent" w/ the latest addition to BRCA.
If a software developer intends for a tool to be totally neutral open source code that can be freely used, and they know that anyone can abuse code, does it make them a criminal?
🚨🚨🚨There is a major flaw in the BRCA of the proposed Clarity Act:
(d) CLARIFICATION OF TREATMENT explicitly states that the protections in subsection (c) DO NOT EXTEND to (or "modify the application of") 18 U.S.C. § 1960(b)(1)(C) for a specific subset of conduct by an "initial person."
18 U.S.C. § 1960 prohibits operating an unlicensed money transmitting business. Subsection (b)(1)(C) covers cases involving the transportation or transmission of funds that the defendant knows are:
(1) Derived from a criminal offense (e.g., proceeds of fraud, drug trafficking, etc.); or
(2) Intended to be used to promote or support unlawful activity (e.g., funding terrorism, further crimes).
This is the exact 1960 subsection now being used to target developers. Every builder and developer knows their tool could be used for nefarious purposes. Under this law, that knowledge alone is enough to send you to prison for years. There is NO PROTECTION for developers in the Clarity Act while this carve out remains.

The appellate court appears to solidify in arguments that mixers are legal in theory, but not in practice.
The same argumentation is being brought by SDNY in the case against Roman Storm: even though mixers are legal, any money going into a mixer is attempted to be classified as part of a criminal conspiracy.
The argument appeared rejected by the judge at the time.

@TFTC21 Exactly this! Any dev in the USA needs actual clarity and not ambiguity that could be reinterpreted later.
Honest builders of neutral self custody and privacy tools deserve this much.
Before the CLARITY Act moves forward, it needs language that clearly protects developers from being prosecuted for how their users choose to use their software.
The Samourai case proved the government will use that ambiguity.
Without even asking, motivated contributors chomping at the bit to help have arrived, and efforts will continue to right what we all know is a heinous injustice.

By the time the truth comes out, the damage is already done. Legal fees pile up. Time disappears. Debt replaces stability. @keonne reflects on a system where defending yourself can cost millions—long before guilt or innocence is ever decided. In cases like these, the verdict almost doesn’t matter. The punishment is built into the process itself. Justice is supposed to assume an equal fight—but when one side has unlimited power and the other has everything to lose, this isn’t justice. It’s enforcement by exhaustion.
Why is @torproject silent? This is a PR disaster for them.
