How to avoid Criminal Liability in a Road Crash:-

Essential Elements of Crime = Mens rea(Guilty mind), Motive & Conduct. If None of these present, then No Crime.

* Step1:- Drive as per MV rules. If still involved in any crash, don't run away. Help the victim & call the police. When Conduct is Bonafide, then No crime.

*Step2:- If escaping from mob attack, report at nearest PS within 24 hrs/ dial 100. When Motive is Bonafide, then No crime.

*Step3:- If crash due to mechanical failure, help the victim & report to Police. If No Mensrea, then No crime.

*Step4:- If still FIR on you, cooperate with investigation. Appy Quashing of FIR before High Court or Discharge before Trial Court.

Note:- There will still be Civil Liability which is why you have insurance. If Motive, mens rea & conduct are Bonafide, then liability upon insurance.

No insurance= Complete civil liability on you + Malafide conduct= Criminal + Civil cases.
