I am genuinely SHOCKED by the level of treaty illiteracy now passing for serious commentary in parts of #India’s policy circles.

Have you even read Article IX(5) of the #IWT before declaring the Court “illegal”? It expressly provides that a Court of Arbitration may be established “at the request of either Party” in circumstances specified there. Annexure G, paragraph 2(b), repeats the same rule. This is not Pakistan’s interpretation: These are the words of the Treaty itself, conveniently available on #India’s own Ministry of External Affairs website!

#India’s refusal to nominate its two arbitrators does not somehow hand India a veto over a process to which it had already consented by treaty. Annexure G contains machinery specifically capable of operating despite non-participation at critical stages of constituting the Court. Paragraph 9 expressly addresses a party failing to participate in the drawing of lots for the umpires. Paragraph 11 then provides that the three umpires, together with “such arbitrators as have been appointed”, shall form the Court, and permits it to transact business when all three umpires and at least two arbitrators are present. Paragraph 16 expressly empowers the Court to decide all questions relating to its own competence.

And this is not some Pakistani gloss on the Treaty. The Court considered India’s objections and unanimously held that India’s non-appearance did not deprive it of competence, that the arbitration had been initiated in accordance with Article IX(3), (4) and (5), and that the Court was properly constituted under paragraphs 4 to 11 of Annexure G. India is perfectly entitled to dislike that conclusion. What it cannot do is erase the actual words of the Treaty and replace them with “we did not participate, therefore the Court is illegal”. That may work as a slogan for the galleries but as treaty law, it is remarkably thin and only exposes your sheer ignorance!

To reform bureaucracy, following have to be reformed simultaneously:

1) Institutions (laws, rules, regulations)
2) Processes (to improve delivery of services)
3) Personnel (meritocracy, specialized bureaucracy, competing for all higher level jobs, KPIs, Accountability).

•Pakistan’s brightest civil servants keep getting donor scholarships (Chevening, Fulbright, JDS) and return with elite degrees—then walk back into the same unreformed file-keeping system.
•World-class training, colonial-era machinery: Unified Pay Scales, outdated Rules of Business, PAS/DMG patronage. Specialists still can’t use what they learned.
•Scholarships often become a stepping stone into donor agencies and consultancies—then those same networks keep writing Pakistan’s policy. Soft capture + hollowed-out local capacity.
•You still can’t brief cabinet unless you’re PAS. The Principal Accounting Officer stays a generalist. Postings stay in the hands of PMs and CMs. Degree ≠ reform.
•Three fixes if training is supposed to help the country, not just the CV: separate federal/provincial/local services with real professional tracks; let specialists shape policy and budgets; independent commissions for appointments, promotions, and tenure.
•Otherwise Chevening, Fulbright, and JDS remain the same story: donor investment in people, converted into donor networks—while the bureaucracy stays stuck.
