▪️In Dheeraj Gupta v. State of Haryana and Anr, Punjab & Haryana HC quashed an FIR registered against a man u/s 294, 354A, and 509 IPC over a WhatsApp remark. Court noted that the comment, “Jaane kitne dinon ke baad society me ab chand nikla,” was neither obscene nor sexually coloured so as to attract the alleged offences.
▪️The complainant, a Principal at a Government School and a resident of Spaze Privvy, Sector 93, Gurugram, alleged that petitioner had posted a lewd and sexually coloured remark on her profile photograph in a housing society WhatsApp group.
▪️According to her, the comment was made with the intent to “embarrass, sexually harass, annoy, humiliate, and defame her in society, and to insult her modesty,” and was supported by other members through messages and emojis.
▪️The petitioner contended that the allegations were fabricated and stemmed from personal vendetta in the backdrop of RWA elections. He argued that remark was a humorous, idiomatic expression, not directed personally at the complainant, and that the essential ingredients of the alleged offences were absent.
▪️It was further pointed out that the complainant was not even a member of the WhatsApp group at the time the message was posted and that there was no mens rea to insult her modesty or sexually harass her.
▪️On the scope of Section 294 IPC, Court noted that “mere abusive, humiliating, or defamatory words by themselves cannot attract an offence under Section 294(b) IPC.”
▪️While holding that a WhatsApp group message could amount to an “utterance in a public place”, Court emphasized that obscenity is the crucial requirement. Accordingly, no offence u/s 294 IPC was made out.
▪️With respect to Section 354A IPC (sexual harassment), Court held that the impugned remark did not amount to a “sexually coloured remark.”
▪️On Section 509 IPC (insult to modesty), Court reiterated that the essence of modesty is linked to a woman’s sex and that culpable intention is the crux of the offence. Therefore, Court held “Mere mocking words and emojis posted by the petitioner on the complainant’s profile, without any nexus to her sexual dignity, cannot amount to an offence u/s 509 IPC.”
