@ProfOjiendaTom Section 16 of the WIBA Act ousts the magistrates courts jurisdiction. And places it upon the tribunal this section was render constitutional in CA 133 of 2011 we need clarity in this grey area.

@dkmaraga the court of appeal rendered judgement in CA 133of 2011 the import is that the courts lack jurisdiction to hear industrial accidents which should be handled by tribunal. Kindly look into this matter we are confused as to whether to continue filling such matters

@dkmaraga the Court of Appeal in CA No.133 of 2011 reinstated section 16 of the Work Benefit and Injury Act.The import of this is that the Magistrate's court lack as jurisdiction to entertain industrial injuries.kindly advice if we should continue filling this cases.
