THE FACTS ARE GETTING CLEARER

The House of Representatives’ Infrastructure Committee held its hearing today and once again, the spotlight was on the Discaya family.

From the start, it was clear: the goal of some lawmakers was to drag the Dutertes into the flood control scandal.

Congresswoman Luistro tried to corner Mr. Discaya, desperate to link the controversy to former President Duterte. But she failed miserably.

Discaya calmly admitted that under Duterte’s watch, there were attempts from certain individuals, including regional directors, to demand kickbacks. But he flatly refused.

Instead of bowing to corruption, he published the results of the public bidding to protect himself. Most importantly, he pointed out that all his projects during Duterte’s time came from programmed funds—transparent, accountable, and within the budget.

The contrast with Marcos is glaring. Under the current administration, most contracts are drawn from unprogrammed funds, which have become the breeding ground of corruption. This is where the so-called “congtractors” step in to squeeze contractors dry.

Discaya exposed how the DPWH’s “three-strikes policy” is now being weaponized. If a contractor resists kickback demands, they’re harassed with right-of-way issues, forced terminations, or deliberate delays. Resist too long, and three disqualifications will get you blacklisted for good. In short, contractors are forced to give in or lose everything.

Discaya insisted that he won his projects fairly through legal bidding. But under Marcos, the system is rigged. The playground of corruption is wide open, and “congtractors” together with DPWH officials are cashing in.

InfraComm chair Cong. Terry Ridon even resorted to raising his voice, trying to intimidate Discaya into submission. Other congressmen attempted to cite him for contempt, but Discaya stood his ground. He would not be shaken.

Meanwhile, Cong. Garin shamelessly tried to weaponize the pandemic in her questioning, forgetting that she herself was part of the very House that approved the budgets. Where was her outrage back then?

President Marcos has been parading his “Sumbong sa Pangulo” program, inviting people to report corruption. But if the Discayas—who spoke out against the system—end up being punished, then this whole exercise is nothing but a smokescreen.

Instead of punishing the guilty, whistleblowers will be silenced. And contractors will learn a dangerous lesson: if you speak out, you will be destroyed while the real thieves walk free.

If the Discayas are guilty, hold them accountable. But don’t make them the scapegoats while the real architects of corruption (the DPWH officials and lawmakers) escape unscathed.

Here’s the undeniable truth:
- Under Duterte, attempts at kickbacks failed.
- Under Marcos, kickbacks tied to unprogrammed funds and “congtractors” flourished.

Jailing the Discayas won’t fix the problem. As long as the House of Representatives and DPWH remain untouched, corruption will keep draining taxpayers’ money.

And no matter how hard they try, one fact remains: the HOR has failed to pin this flood control scandal on the Dutertes because the rot lies squarely under Marcos’ watch.

PS || This is my mere observation about the InfraComm hearing today. I was listening carefully to both sides (Discaya vs. Congressmen) and it seems to me that the Discayas are serious about exposing the system of corruption and the people involved. Yet, some lawmakers are trying to put all the blame to the Dutertes, which failed big time for me.
