#WATCH: Five judges are set to be elevated to the Supreme Court of India. Two among them have superseded judges senior to them. One such judge is Chief Justice of the Himachal Pradesh High Court, G.S. Sandhawalia—an honest, upright judge of unimpeachable integrity. No one pushed for his, or Justice Atul Sreedharan’s elevation within the Collegium.

The CONSISTENT failure to bring fiercely independent and upright judges to the country’s highest constitutional court is becoming one of the GRAVEST failures of the Collegium. Equally troubling, if not more, is the complete SILENCE of the political opposition on these questions. One cannot remain indifferent during appointments and then suddenly discover outrage only after controversial judgments like SIR are delivered.

The judicial institution has been weakened not overnight but through steady erosion. Silence, compromise, opacity, selective courage, and the complete normalisation of mediocrity over brilliance and integrity.

Unfortunately, if this trajectory continues unchecked for a few more years, there will eventually come a point where large sections of people begin LOSING all faith in the very legitimacy of this system itself. And it already appears to have begun.

Courts survive because people continue to believe that justice, fairness, and constitutional morality still meaningfully reside within them. The day that belief collapses—complete chaos. It is something all of us need to think urgently about before it becomes too late.

🔹SIR is always a matter of substance, never merely a matter of form. The issue was never about the power to conduct SIR. What was being questioned was the mode, manner, timing, and style in which it was being carried out.

🔹 The Court, in Para 171, states that the formal and final determination of citizenship cannot be done by the ECI. That power lies with the competent authority under the Citizenship Act — namely, the Ministry of Home Affairs. Yet, the ECI has already excluded people on the basis of citizenship.

👉 Is this not a contradiction?

👉 Should this not have invited notice, findings, and comment from the Supreme Court?

🔹Paras 97 to 100 of the Supreme Court order underline several deficiencies, gaps, omissions, and errors on the part of the ECI. This shows that the ECI was in error, and the gaps had to be filled through petitions filed by NGOs and political parties like ours.

VIDEO | Activist and psephologist Yogendra Yadav, who was a litigant in the Special Intensive Revision (SIR) case before the Supreme Court, said, "As one of the litigants, I have reasons to be disappointed, but I am shocked. Not shocked only because I was litigant and the judgment did not go in my favor. That can happen. Not shocked because I had expected a very different judgment. For the last few months, the course, the very strange course that this particular case had taken, made it absolutely clear which way things were going. I'm shocked that the Supreme Court of this country has allowed the fundamental democratic principle to be overturned. In a democracy, voters choose the government. The government cannot choose the voters. And the net effect of what the Supreme Court has done today is that now BJP shall decide who can be a voter in this country and who cannot. Technically, you might say Election Commission will decide. But because the same Supreme Court has done absolutely nothing to ensure that the Election Commission's own appointment is a non-partisan way, and given the manner in which the Election Commission behaves these days, it is absolutely true that now BJP decides who will be the voter, and on the basis of their votes, BJP will say, "We have one popular mandate." This is a complete overturning of the fundamental principle of universal adult franchise...I'm astonished that the Supreme Court of India has put its seal of approval on fundamental overturning of democratic principles."

Supreme Court upholds the decision of Election Commission of India’s (ECI) to undertake Special Intensive Revision (SIR) of voter rolls that started in Bihar.

A bench led by CJI Surya Kant has held that the SIR exercise cannot be struck down as ultra vires (illegal) just because it’s a process different from ordinary exercise of revision of voter rolls.

The Court has termed SIR as legitimate and constitutional exercise. “The exercise is legally tenable”, it added.
