In the lawsuit over damages related to the advertising contract between health food company FromBio and actor Kim Soohyun and his agency Gold Medalist, the court focused on three main issues: whether Kim Soohyun’s side was responsible for the situation, whether he could still carry out his duties as an advertising model, and whether he should return the model fee.
At the fourth hearing on August 19, FromBio argued that there were problems not only with the controversy surrounding Kim Soohyun, but also with how Kim Soohyun and his agency handled the situation afterward. FromBio said Kim Soohyun’s side was responsible for the situation eventually reaching a point where he could no longer be used as an advertising model.

FromBio argued that how Kim Soohyun and his agency explained and handled the controversy after it happened during the contract period could also be considered when deciding who was responsible under the contract. It clearly maintained that Kim Soohyun’s side was responsible for the situation in which it became difficult to use him normally as an advertising model.
In particular, FromBio stressed that an actor’s image built over the years and the public’s trust in the actor are important parts of an advertising model contract. Considering this, FromBio said it was necessary to determine who was responsible for the situation that made it difficult to use Kim Soohyun as an advertising model.
On the other hand, Kim Soohyun’s side argued that the incident that happened before the contract was signed cannot, by itself, make him responsible under the current advertising contract. They acknowledged that the actor and his agency’s actions after the controversy could be considered because they happened during the contract period. However, they maintained that there was nothing wrong with how they actually handled the situation that could be considered a breach of contract.
What if the contract could not be carried out even without fault? The issue of returning the model fee
The court also looked at what would happen if Kim Soohyun’s side was found to have no fault at all.
Even if Kim Soohyun’s side was not at fault, if the advertising contract was considered impossible to carry out, the court raised the possibility that the rules on who bears the risk when a contract becomes impossible to carry out without fault could apply. This could leave an issue over whether some or all of the model fee should be returned.
Kim Soohyun’s side rejected this, saying that this was not a case where the contract became impossible to carry out in the first place. They argued that they had already completed their duties as an advertising model, including filming the advertisement and completing the process needed for the advertisement to be released. Whether the advertisement was actually released was the advertiser’s decision.
Therefore, they argued that simply stopping the advertisement could not be considered a failure or refusal by Kim Soohyun’s side to carry out the contract.
Even if the court accepted this argument from Kim Soohyun’s side, it said there was still a need to separately consider how the parts of the contract that had already ended or could no longer be carried out should be handled legally.
The court therefore suggested that FromBio also consider, separately from its current claim that the contract was breached, whether the model fee should be settled or returned under the rules on who bears the risk when performance becomes impossible without fault.

[0813] The first trial of Kim Seui, head of Garosero Research Institute, who has been brought to trial on charges of spreading false information about famous YouTuber Tzuyang (real name Park Jeong Won), will begin today.
Judge Jeong Ahyoung of the Seoul Central District Court’s Criminal Division 20 Single Judge will hold the first trial hearing in the first instance at 11:10 a.m. on August 13 for Kim Seui’s case, involving charges of violating the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. (defamation), violating the Stalking Punishment Act, and making threats.
Kim Seui is accused of using Tzuyang’s private life to create and distribute provocative content for the purpose of generating profits through fundraising, including through a sponsorship account.
He is also accused of forcing Tzuyang to make a broadcast explaining the contents of the revelations and maliciously defaming her.
The investigation into this case began after Tzuyang’s side filed a complaint with Seoul Gangnam Police Station in July 2025.
On March 31, 2026, the Seoul Central District Prosecutors’ Office’s Women and Children Crime Investigation Division 2 indicted Kim Seui without detention on charges of violating the Information and Communications Network Act, violating the Stalking Punishment Act, and making threats.
