@TropperJohannes …and on the one hand suggesting the MS take a position in favor of adoption of the modernized treaty, on the other hand that they should not be “Present and Voting” at the Conference adds to this confusion.
@TropperJohannes They would need to follow through also with the ratification then, would they not? Otherwise, the necessary 3/4 under Article 42(4) may not be reached. Should generally be welcomed, of course. But the constant changes in the COM‘s position just create confusion and uncertainty.
It is #Nicaragua's right to pursue an #ICJ case vs #Germany. But one might ask when Nicaragua (with its broad optional clause declaration) will find itself on the other side of ICJ public interest litigation. From the 28 Feb 2024 report of the HRC's Group of Experts on Nicaragua:
