CONSTITUTIONAL COURT FINDS JUDGE'S RECALL OF WITNESSES IRREGULAR

In Tshabangu v S the Constitutional Court held that the high court's recall of two police witnesses under ss 167 and 186 of the Criminal Procedure Act 51 of 1977 constituted a serious irregularity vitiating trial fairness, engaging its jurisdiction per S v Van der Walt. Applying R v Hepworth, S v Gerbers, S v Masooa, S v Lubisi and S v Rall, the Court found the recall was not trial-related but aimed at investigating apparent record-tampering, was triggered by inadmissible submissions from a co-accused rather than evidence, and involved leading questions that improperly rehabilitated the State's case after it had already failed. The high court Judge had further erred in declining to recall a witness on the applicant's possible prior conviction while readily recalling witnesses favourable to the prosecution, and in disregarding unfavourable testimony, creating an impression of partiality. As no admissible evidence linked the applicant to the offences at the close of both cases, applying S v Kwinika, acquittal was required. The recalled evidence fell to be disregarded, and the resulting convictions could not stand.

The appeal succeeded. The Court set aside the high court order; replaced it with an acquittal on all counts; and directed the applicant’s immediate release from custody, absent other sentences.
