A great deal has been said about the birthright citizenship decision, but the central point is that Justice Thomas completely exposed the logical incoherence at the heart of Chief Justice Roberts’ “reasoning.”
You cannot reconcile a constitutional framework that denies automatic citizenship to members of Indian tribes, even when born on U.S. soil, with a doctrine that automatically hands out citizenship to Chinese and other birth tourists as if it were candy.
There is no logical, coherent, or even barely comprehensible way to square those positions. It is simply not possible. If Native Americans are not entitled to Fourteenth Amendment citizenship, then neither are birth tourists.
Just to give you guys an idea of how terrible the SCOTUS decision is today, the literal framers of the 14th amendment themselves agreed with Trump. They made it abundantly clear that “subject to the jurisdiction thereof” does not apply to all people in America, but only citizens.
The amendment also wasn’t even interpreted in the way it is today until after the framers themselves had all passed away. Congress had to pass the Indian Citizenship Act of 1924 to give Native Americans universal citizenship EXPLICITLY because the 14th amendment was understood to not apply to everyone in our country.
This just goes to show that traitors like ACB aren’t voting based on “originalism” like some are trying to claim. The true originalist constitutional position is Trumps view, Barrett is just a liberal feminist who just happens to be pro life.
