The Sarnia Police Service would like to remind the public that mobility scooters are not considered vehicles under the Highway Traffic Act and cannot be driven in the roadway.
Earlier this week, a member of the SPS Traffic Services Unit stopped the user of an enclosed mobility scooter operating on the road. The individual was issued a warning to use the sidewalks while operating the mobility scooter.
Mobility scooters, even ones enclosed like the one in the attached image, are considered a “wheelchair” under the Highway Traffic Act. Individuals using a wheelchair are considered pedestrians under the Act. This means that if there is no sidewalk available for the use of a mobility scooter, the individual must travel on the left side of the road facing oncoming traffic as close to the left as possible (Section 179 (1)).
Road safety is a shared responsibility. Please ensure you are aware of traffic laws related to your personal situation (i.e. walking, cycling, driving, etc.) and follow them as written.
