In this case, as in many others, we opposed lowering the $200,000 bond initially set by a judicial commissioner AND the release on his own recognizance (ROR) by the judge.

As you know by now, the District Attorney's office can argue for bond and against ROR, but the judge makes the decision. In this case, the court disagreed with our assessment and recommendations.

Be sure if the defendant violates the terms of release, we will be ready to ask the court to reincarcerate him. As for the case, we will further investigate, build a strong case, and prosecute vigorously.

🚨 This morning I sent a letter to DA Mulroy requesting he file a Writ of Certiorari in the matter of Tyreese Earnest who was released without bail on his own recognizance despite a judicial commissioner labeling Earnest as a danger to the community.

In a statement given to the press, DA Mulroy stated he respected the decision made by controversy-stricken Judge Anderson. DA Mulroy may respect the decision, but he doesn’t have to accept it as final. I can tell you that I do not respect the decision, nor do the people of Memphis respect Judge Anderson’s decision. While Judge Anderson has the authority to make this decision that we honor under the law, only the district attorney has the ability to file a Writ of Certiorari to have a Criminal Court Judge overrule a General Sessions Judge like Bill Anderson and fix such an injustice.

Furthermore, Judge Anderson does not deserve the respect of anyone who is determined to solve our crime problem. He certainly doesn’t deserve the respect of any DA who is serious about keeping law-abiding citizens in Shelby County safe. Judge Anderson recently ignored my new law requiring safety of the community as the first consideration when setting bail which earned him a complaint to the Board of Judicial Conduct. He apparently refuses to apply this important law correctly. Laws do not cease to exist just because Judge Anderson chooses to ignore them!

I’m willing to take the slings and arrows from soft-on-crime Restorative Justice Schemers if it means those who work in the criminal justice system finally take our demands to tackle our crime problem seriously. Justice demands it.
