The #SAPS Phuthaditjhaba Family, Child Protection and Sexual Offences (FCS) Unit, together with the National Prosecuting Authority (NPA), has welcomed the conviction and sentencing of 30-year-old Themba Malinga from Boiketlo Village, Qwaqwa.

Malinga was sentenced to life imprisonment for rape and 15 years’ imprisonment for attempted murder at the Phuthaditjhaba Magistrate’s Court on Thursday, 6 August 2026.

The matter was heard before Magistrate Msimanga, with Ms Nteo representing the State. The investigation was conducted by Detective Warrant Officer Malefu Doreen Mbule of the Phuthaditjhaba FCS Unit.

On 16 August 2022 at approximately 21:00, a 25-year-old woman from Boiketlo Village in Qwaqwa was walking alone near a tavern when she was confronted by Malinga, whom she knew.

It is reported that Malinga covered her mouth with his hand and dragged her to a nearby donga, where he instructed her to undress before raping her. He subsequently took her to his residence, where he continued to rape her several times during the night.

At approximately 04:00 the following morning, Malinga attacked the victim with a broken beer bottle, causing a serious injury to her neck. He then fled the scene without rendering any assistance.

The injured victim managed to reach a nearby house, where she received assistance before being taken to hospital.

The suspect was traced by police in 2022 but could not be arrested at the time.

In 2025, the victim unexpectedly came across Malinga and immediately went to the police station to report his whereabouts. Police subsequently arrested him. He was denied bail and remained in custody while the matter proceeded through court.

Malinga was ultimately found guilty of rape and attempted murder and sentenced to life imprisonment for rape and 15 years’ imprisonment for attempted murder.

The Free State Provincial Commissioner, Lieutenant General Thabang Lesia, welcomed the sentence and commended the investigating officer for her diligent work in ensuring that the accused was brought to justice.

“The sentence sends a strong message that crimes against women and children remain a priority for law enforcement and the criminal justice system. I commend the investigating officer for her excellent work and the victim for immediately reporting to the police when she encountered the accused, which ultimately led to his arrest and conviction,” said Lieutenant General Lesia.

ActionSA Member of Parliament Dereleen James has rejected allegations made against her during testimony before the #MadlangaCommission of Inquiry, describing them as a "blatant lie" and requesting that CCTV footage from Parliament be secured and reviewed to clear her name.

James issued a media statement today, Wednesday after her name was mentioned during the ongoing testimony of State Advocate Drushantha Ramsamy, who is giving evidence as part of the commission's inquiry into the conduct of the Investigating Directorate Against Corruption (IDAC).

In her statement, James denied claims that classified documents had been slipped under the door of her parliamentary office. She said access to her office floor is strictly controlled and monitored by security cameras, adding that she has formally requested the South African Police Service (SAPS) to preserve and review the CCTV footage. According to James, the footage will show that no such delivery took place and that only her staff had access to the area.

She also denied ever meeting with IDAC officials or agreeing to act as a witness in any related investigation.

James said the matter dates back to 13 January 2025, when her staff alerted her to a News24 report alleging that Crime Intelligence had purchased a hotel using covert funds. She said she subsequently called on the Independent Police Investigative Directorate (IPID) to investigate the allegations.

According to James, she was later contacted by a man who identified himself as an investigator from the National Prosecuting Authority (NPA), who requested a meeting and suggested that IDAC, rather than IPID, should handle the matter. She said the approach immediately raised concerns, and she instructed her staff that she wanted no further engagement because she believed "something was dodgy."

"I am grateful that I trusted my instincts to stay clear of a clearly dodgy situation," James said, adding that, in hindsight, it explained why some people became angry with her for refusing to cooperate.

James said the allegations should be viewed in the broader context of the Madlanga Commission, which is investigating allegations of criminality, political interference, and corruption within South Africa's criminal justice system following claims made by KwaZulu-Natal Police Commissioner Lieutenant-General Nhlanhla Mkhwanazi.

The claims involving James emerged after Ramsamy told the Commission that, James was expected to provide evidence in an IDAC investigation into the alleged purchase of two properties using Crime Intelligence covert funds, but instead lodged a complaint with IPID after allegedly failing to meet IDAC investigators or respond to calls from chief investigator Dylan Perumal.

The allegations remain untested before the commission. James has not been called to testify and has denied any wrongdoing.

The Madlanga Commission is expected to conclude its public hearings before submitting its final report on 16 November 2026.

Lt Gen Modise Appointed Mpumalanga Police Commissioner:

Lieutenant General Nkankoane Apaphia Modise has been appointed as the new Provincial Commissioner of Mpumalanga, effective 1 August 2026.

A SAPS veteran with 37 years of service, she joined the police in 1989 after training at Hammanskraal Police Academy. She built her career from constable to senior leadership, specialising in the Family Violence, Child Protection and Sexual Offences (FCS) Unit before serving as Station Commander, Cluster Commander, and later Deputy Provincial Commissioner for Crime Detection in the Free State.

Lt Gen Modise holds a National Diploma in Policing and a BA in Public Administration, bringing extensive operational, investigative and leadership experience to her new role.
