The Kirk Act
An Act to Promote Academic Neutrality and Protect Federal Funding for Institutions of Higher Education.
Purpose
The purpose of this legislation is to ensure that professors at federally funded universities refrain from injecting personal political comments or teaching political ideologies in their classrooms or official capacities. This measure aims to foster an unbiased learning environment, protect students from coerced viewpoints, and safeguard taxpayer dollars by conditioning federal funding on compliance.

Key Provisions
1. Definition of Prohibited Conduct:
• “Political comments” shall include any statements expressing support for or opposition to political parties, candidates, policies, or ideologies that are not directly relevant to the academic subject matter being taught.
• “Teaching political ideology” shall include any instruction that promotes a specific political viewpoint as fact, rather than presenting balanced, evidence-based analysis of historical or current events.
• Conduct must be provable through documented evidence, such as audio/video recordings, written materials, or witness testimonies from students or colleagues.
2. Reporting and Investigation Mechanism:
• Universities shall establish a confidential reporting system for students, faculty, or staff to report instances of prohibited conduct.
• Reports must be investigated by an independent university committee within 30 days of receipt.
• A report is considered valid if the investigation confirms the conduct occurred and it meets the definitions above.
3. Three-Strike Policy:
• Upon the third validated report of separate incidents against the same professor within a five-year period, the university shall be legally required to terminate the professor’s employment.
• “Separate circumstances” means distinct events, not multiple reports from the same incident.
4. Consequences for Non-Compliance:
• If a university fails to terminate the professor after the third validated report, it shall lose eligibility for all federal funding, including but not limited to grants, loans, and subsidies under Title IV of the Higher Education Act of 1965.
• Funding revocation shall take effect 90 days after notification of non-compliance by the U.S. Department of Education, allowing time for appeal.
• Reinstatement of funding may occur only after the university demonstrates compliance, such as through termination of the professor and implementation of corrective measures.
5. Appeals Process:
• Professors shall have the right to appeal investigations through an internal university process and, if necessary, through federal courts.
• Universities may appeal funding revocation decisions to the U.S. Department of Education.
6. Implementation and Oversight:
• The U.S. Department of Education shall oversee compliance and issue guidelines for universities within 180 days of enactment.
• Universities must annually certify compliance as part of their federal funding applications.
• This law shall apply to all public and private institutions receiving federal funds.

Rationale
