I've said for years that the justice system is a sick game played by even sicker rules. Read this and try telling me I’m wrong.

Three weeks after Luke Mitchell was convicted, the prosecutor gave the Daily Record an interview. Here's what got printed.

The police thought there was not enough evidence
"When Mitchell was charged, nine months after the killing, they were sure they had the right man. But some admitted to fears the evidence against the teenager was too thin."

That's not me saying that. That's the Daily Record, in the same article that calls a 16 year old child a "schoolboy monster”. Found guilty on evidence that the police feared was TOO THIN.

But does evidence matter when there is a game to play.

The whole case was two things
The Record says Turnbull "homed in on two compelling pieces of evidence." A courtroom mock-up of a wall, and an admission from Luke's brother.

Two pieces of evidence they said was compelling. For a life sentence.
(Note: From what I'm researching "compelling" is a misspelling of "flimsy")

And here's the game they played, in the prosecutor's own words
"I always felt your first line of attack should be the law. If you were arguing about the facts then you really were one goal down already."

There it is. In black and white. Scotland's top prosecutor saying that if you're arguing about the facts, you're already losing.

FACTS. The TRUTH of what happened. That's the LOSING position for the prosecution.

And the Record spells it out: "he won every legal argument raised to pave the way for convictions."

Not proved the case. WON the arguments.

That was the game.

And this is what it was played with.

Two pieces of evidence that police thought was too thin. A prosecutor who tells a newspaper that arguing the facts leaves you a goal down. And a 14 year old child.

Most of what happened in that courtroom was permitted. And where the defence said the rules HAD been broken, it was waved away. The system let all of it happen.

As I say, a sick game, played by even sicker rules.

And the public will never get to know the final score in this game that sent a child to prison for life because it’s shrouded in secrecy.

They only revealed the result. And the score could be 8 votes to 7 for all we know.

With the system as shambolic as that, I’m surprised they didn’t dispense with the trial and decide Luke Mitchell’s fate on the flip of a coin.

It would have saved taxpayers a fortune. But I suppose that would have deprived some people of what the prosecutor calls "the thrill" of the game."

A child was sent to prison at the end of that game and has been there ever since. More than 21 years now (22 including remand) and they refuse to have a replay. Even though to every right thinking person it’s obvious his conviction is profoundly unsafe.
