Fauci has no legal authority to invoke the Fifth Amendment.

Brown v. Walker, 161 U.S. 591 (1896): The Court held that a witness is excused from testifying only if legal detriment (i.e. criminal liability) could flow from the testimony. If a statute of limitations has run or a pardon has been issued for the offense, the privilege cannot be claimed, regardless of other detriments like loss of reputation. This remains a foundational statement that the privilege is unavailable once the risk of incrimination is eliminated by operation of law.
