Turkey will appear before the UNCAT today, headed by an alleged perpetrator of international crime!!!

✅This morning the UN Committee Against Torture will start reviewing Turkey’s compliance with the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment.

✅Ms. Kıvılcım Kılıç, the head of the Turkish delegation for the dialogue with the Committee, was the Ambassador to Kosovo from July 1st, 2015, to December 20, 2018, and she will present today how Turkey has been fighting torture over the last ten years.

✅The Committee will have a great opportunity to ask for fist-hand information about how transnational illegal abductions and renditions involving brutal torture and ill-treatments have been carried out through the use of Embassy facilities.

✅There is credible evidence that the Turkish embassy in Pristina, and Ms. Kıvılcım Kılıç in particular, were deeply involved in the rendition/abduction of six Turkish citizens following an operation jointly carried out by the Kosovar police and MİT (Turkish intelligence services) in March 2018.

✅The UNWGAD rendered an opinion against Kosovo and Turkey on these cases finding the rendition and detention arbitrary. The Working Group asked both States if compensation or other reparations have been made to abducted persons, and whether an investigation has been conducted into the violation of their rights, and, if so, the outcome of the investigation (https://t.co/EeEDUNCMpc).

✅The Nordic Monitor revealed that
“Nordic Monitor previously published a secret Turkish foreign ministry communiqué in which the Turkish Embassy in Kosovo profiled 78 people who had listed their profession as teacher when they made applications with the consulate for various citizen services (…) Profiling files were conveyed to the foreign ministry by Kıvılcım Kılıç, the Turkish ambassador to Kosovo between 2015 and 2019. According to local sources in Kosovo, the Turkish Embassy was key to the logistics and planning of the abduction and served as a detention center for the operation. The Turkish nationals — Cihan Özkan, Kahraman Demirez, Hasan Hüseyin Günakan, Mustafa Erdem, Yusuf Karabina and Osman Karakaya — were kept for a time in the embassy chancery or at the residence of then-Turkish Ambassador Kılıç. It was alleged that MİT was instructed to kidnap five Turks but that Özkan was added to the list in Pristina by Ambassador Kılıç. The Cumhuriyet daily reported that pictures distributed by the state-run Anadolu news agency after their arrest were taken on the Turkish Embassy premises in Pristina.”

✅The head of Kosovo intelligence and officials involved in this kidnapping are being tried in a Kosovo court. Although the fact that an alleged perpetrator of crimes against humanity, Kıvılcım Kılıç, is heading the Delegation of Türkiye today before the UNCAT is outrageous, it’ll allow the Committee not to let this situation unnoticed and ask for first-hand information to Ms. Kıvılcım Kılıç on the Turkish practices and state policy of abduction, including incommunicado detention and torture of abductees, and an update on any investigation, if any, against her and her staff, carried out on the case.

✅Gökhan Açıkkollu was a teacher. He was detained for his legal and routine activities. During his detention he was not allowed to take medication, was tortured and died. The United Nations Human Rights Committee found a violation against Açıkkollu. However, no action was taken against the torturers. Because after 15 July, torturers and those who committed crimes were protected by law. Açıkkollu's murderers are still working as public officials!

✅We are eagerly waiting to see how the Turkish delegation headed by Kıvılcım Kılıç, who was allegedly responsible for the abduction of 6 Turkish citizens from Kosovo when she was Ambassador to Kosovo, will answer the direct questions of the UN Committee against Torture about Açıkkollu. Torture and ill-treatment are crimes against humanity and there is no statute of limitations!

✅International Criminal Court judge Aydın Sefa Akay was arrested and sentenced to 7.5 years in prison for using a communications app despite having diplomatic immunity. Just as nearly 5,000 Turkish judges and prosecutors, who enjoy legal and constitutional guarantees, have been dismissed, arrested and sentenced to imprisonment without even hearing their defence. Hundreds of judges and prosecutors are still imprisoned on the same grounds as in the Yalçınkaya judgement, the most serious violation in the ECtHR's 63-year history, namely for legal and routine activities. Just as the ECtHR ruled that more than 1,500 judges and prosecutors were wrongfully imprisoned, it also ruled that Aydın Sefa Akay was wrongfully imprisoned and deprived of his liberty.

✅Şerife Sulukan is a teacher with 89 per cent disability. Like tens of thousands of others in similar situations, she was penalised for her legal and routine activities, but despite her disability her sentence was not suspended and she was imprisoned. In prison, she does not receive adequate physiotherapy and does not eat well. In a letter to human rights defender MP Ömer Faruk Gergerlioğlu, he said: "I need heart surgery but this is not possible. The number of physiotherapists is insufficient. My crime is sending my child to a school with 60 per cent state funding. I will not get better here, I will get worse."

✅According to 2023 data of the Ministry of Justice, 552 children between the ages of 0-6 are in prison with their mothers in Turkey. As the mothers of these children are in prison for their legal and routine activities, these children have to grow up in prisons even though they have not committed any offence.

✅Yusuf Bilge Tunç, a civil servant, was abducted in broad daylight in the centre of Ankara and has not been heard from for 5 years. His family believes that he died as a result of torture. The Ankara Chief Public Prosecutor's Office did not carry out an effective investigation despite dozens of evidences and turned a case with a "known perpetrator" into "unknown perpetrator". There are dozens of people in Turkey, especially after 15 July, who were abducted by MIT and have not been heard from. Tunç is only one of them.

✅The National Intelligence Organisation (MIT) abducted 5 teachers and 1 doctor from Kosovo and brought them to Turkey in 2018. The United Nations Working Group on Arbitrary Detention found unlawful detention, deprivation of liberty and arbitrary arrest for 6 Turkish citizens abducted from Kosovo. According to the UN resolution, which pointed out that there were separate grievances and responsibilities for both Kosovo and Turkey, Turkey was supposed to release the 6 people and Kosovo was supposed to pay compensation. However, the Government, which does not implement the ECtHR and UN judgements, did not implement this decision either, and the freedom of 6 innocent people was unlawfully taken away from them.

✅Interestingly, Kıvılcım Kılıç, the then Ambassador of Kosovo to Pirishtina, who was directly involved in the abduction of 6 Turkish citizens from Kosovo, was the head of the Turkish delegation. We are eagerly waiting to see how the Turkish delegation will respond to the UN Committee against Torture's questions about the abductions carried out by MİT from abroad, especially against the Gülen Movement, and the impunity of the personnel following these incidents.

✅"Eyup Birinci, a former school teacher in the southern town of Antalya, was among those tortured, and Human Rights Watch documented his case at the time. Beaten so badly that he required emergency abdominal surgery, Birinci made numerous complaints of torture that were repeatedly rejected. Only now, after the completion of a new investigation 8 years later, will three police officers and a doctor face trial: two police officers for alleged torture, a third officer and a doctor for ignoring it. Birinci’s case is a rare exception since the Turkish authorities fail to investigate the vast majority of cases of alleged torture, let alone bring them to trial.

✅Human Rights Watch has also highlighted the Turkish authorities’ failure to investigate a pattern of enforced disappearances including reports of torture. While some of these occurred in Türkiye, other cases occurred overseas and the intelligence services have publicized and celebrated the forced repatriation to Türkiye of individuals they allege are connected with the Gülen movement."
