Major Bello Magaji N/6604 lured 4 boys Emmanuel Enega, Joseph Unigbe, Mohammed Abubakar and Isaac John within the ages of 15 - 17 and residents of Army Cantonment Ojo and had anal sex with them in his apartment. He used one other boy Oscar to source for these boys with the promise of giving them mental jobs. When they come to his apartment, he will give them beer to make them tipsy, then convince them to bathe and change to boxers and lie on his bed. He then makes his move on them. He also tells them to rub cream on his penis which he uses to sodomize the boys in their drunken state. In his confession, the Major himself stated that he made passes with the boys and they massaged his body including in his private parts and they were both naked. The court-martial convicted him and sentenced him to 7 years in prison. The Supreme Court upheld the conviction and Justice Niki Tobi described the Major's action in this manner
"By his conduct, the appellant re-ordered God's creation. Has he got the power to do that? No. No human being, whether in the military or not, has the power to re-order God's creation. After all, we are not talking of fighting a war. By his conduct, the appellant has brought shame to himself. Although a bit of the dent is on the Army, I am not prepared to hold that Force guilty of the conduct of the appellant. The Army did not ask him to commit this heinous and atrocious offence. He is a terrible criminal. And he is alone, clearly alone. "
The man in this case is now a Dean of Law Faculty in Nigeria. Pardoned. No longer a criminal. 😁😁😁
If you attended OOU between 2015 and 2020, you will be familiar with the Supreme Court case of Major Magaji v Nigerian Army. We knew the facts of the case like the back of our hands. Mr Osinibi used the case for “Offences against the order of nature”.
Guess what? The same Major Magaji is now a freeman and a university lecturer.
