Fresno, California mother 𝐒𝐡𝐚𝐧𝐚 𝐆𝐚𝐯𝐢𝐨𝐥𝐚 has 16 days left before she must report to federal prison—the outcome of a family fight over her son’s gender identity that split a jury, a judge, and now a national parental-rights movement.

According to Gaviola, her son began questioning his gender around age 13, and school counselors affirmed a transgender identity and discussed transition-related steps with the boy without her knowledge or consent. By 2020, then 16, he was living apart from her with another family, had petitioned for emancipation, and had obtained a domestic violence protective order against his own mother from a Fresno County court.

The following August, according to the Justice Department, people acting on Gaviola’s behalf pulled the teen from an ice rink, handcuffed him, and drove him more than 𝟐𝟒 𝐡𝐨𝐮𝐫𝐬 to Stockton, Missouri—in direct violation of that protective order. A federal jury convicted her in December of interstate violation of a protection order, and a judge sentenced her to 𝐭𝐡𝐫𝐞𝐞 𝐲𝐞𝐚𝐫𝐬 in prison.

Gaviola doesn’t dispute the timeline. She disputes what the jury was allowed to hear.
