I don't want innocent people convicted because only circumstantial evidence. You can't just convict on 'feels'

It would be cheaper to litigate it at that point and force them to try to prove damages financially, which they will struggle to do. $5M is a lot. Probably settle around $500k, unless they can show malice or something substantial.
