COURT DIRECTIONS ON THE SIX GROUNDS AND 63 DISPUTED POLLING STATIONS
Following her ruling, Lady Justice Flavia Nabakooza issued further directions governing the presentation of the petitioner's evidence.
The petitioner was directed to proceed on six grounds of the petition that remain for determination. In respect of each ground, the petitioner is to call not more than three witnesses, in accordance with the directions of the court.
The court also issued a specific direction concerning the 63 disputed polling stations. The petitioner was directed to call 63 witnesses to testify before the court, with one witness relating to each of the 63 disputed polling stations.
The witnesses will therefore be required to give evidence concerning the respective polling stations forming part of the petitioner's case. This direction relates specifically to the evidence concerning the 63 disputed polling stations.
The court further addressed the ground concerning Hajjat Minsa Kabanda's academic qualifications. Although the respondents had sought to have this ground struck out, the court allowed it to proceed. The petitioner was directed to call at least one witness to testify in support of the evidence concerning the disputed academic documents.
These directions followed the court's decision to expunge the affidavits that had been filed without the requisite leave of court and set out the framework within which the petitioner will now present the evidence supporting the surviving grounds of the petition.
The petition will therefore proceed on the grounds and evidence that have been permitted by the court, with the petitioner required to comply with the directions concerning witnesses and testimony.
In addition to arresting our comrades at church, the regime police and the Rubaga RDC have cancelled our planned football match between Foot Soldiers and NUP leaders that was to be held at Kitebi Primary School playground today. Without any clear justification, they have already deployed security forces all over the venue to prevent our comrades from attending the match.
In the strongest terms possible, we condemn the blatant misuse of power by the regime officials who have failed to come to terms with the fact that we are a legally registered and law abiding political party. We call upon all regime officials to refrain from being used as agents of oppression.
