CONVERSION IS A CONSTITUTIONAL RIGHT. FORCE IS A CRIMINAL ACT. THE MOB DOES NOT GET A VETO.
A viral video alleges the religious conversion of over 500 Hindus at a Hyatt hotel in Janakpuri, Delhi. Some who raised objections were allegedly assaulted. The Delhi Police has been tagged. The facts remain unverified. But the legal framework is not.
Article 25(1) guarantees to all persons the freedom of conscience and the right freely to profess, practise and propagate religion. The Supreme Court in Rev. Stanislaus v. State of Madhya Pradesh (1977) held that the word "propagate" does not include a right to convert another person to one's own religion. Conversion is a choice. It is not a crime.
The Constitution was shaped for the common man. The common man's conscience is his own. Article 25 protects the individual's right to change his faith as much as it protects his right to keep it. Delhi has no anti-conversion law. Twelve states do. Delhi does not. That is the constitutional reality.
The courtroom is the last refuge of the individual against the collective. The mob that "raised objections" and allegedly assaulted people is not enforcing the law. It is enforcing its will. IPC Section 295A punishes deliberate and malicious acts intended to outrage religious feelings—not the act of conversion itself. Section 153A punishes promoting enmity between religious groups—not the exercise of constitutional rights.
The crowd demands uniformity: "Do everything as we do, or you are an outcast." The crowd that objects to conversion is not defending religion. It is defending conformity.
The Constitution does not permit the mob to veto a citizen's conscience. If coercion, fraud, or assault occurred, the Delhi Police must act under the law. If it did not, the law protects the right to convert. Either way, the answer is the same: due process, not the mob.
