Some thoughts on Advocacy:
1. You can persuade a Court successfully only & only if you are able to spell-out what you're asking for - clearly, precisely and politely.
2. The next task is convincing the Court that it is not only within Court's jurisdiction to do (what you're asking it to do) but also a duty on the court to do it. (Power coupled with a Duty).
3. The best counsels don't stop there. They don't just give the Courts a legal reason to act but also an ethical one. They go a step beyond & demonstrate that what they are asking the court to do is not only the legal way of going about it but also the most ethical, fair, reasonable and honourable way, and - if one must add - the only way to do justice & avoid injustice.
The view suggested by you should be the BEST view in the circumstances; both in this case and also in terms of the precedent its lays down for future decisions.
No human being wants to lay down a legacy of being an instrumentality of injustice.
Demonstrate that the view taken by the Court should not set a dangerous precedent & be open to distortion & thereby lead to injustice in thousands of cases & for hundreds of years.
