This is how a UK jewish housing association set a legal precedent to discriminate against non-jews.
In 2017, a British non-jewish single mother of four was rejected by the Agudas Israel Housing Association (AIHA), a registered charity.
The mother was living in overcrowded, inadequate temporary housing with two autistic children. She was placed into the highest-priority housing band (Band 1) in June.
When six suitable 4 bed properties owned by AIHA became available in Stamford Hill in late 2017, Hackney Council did not nominate her, and she was bypassed.
The mother began a gruelling 4 year legal battle:
- Feb 2018: she sued Hackney Council and AIHA for discrimination under the Equality Act 2010 (Z v Hackney). Both Hackney Council and AIHA admitted to direct religious discrimination under Section 13 of the Equality Act 2010.
- Feb 2019: High Court dismissed the claim. To legally justify a 100% restriction as a 'positive measure', the court accepted four reasons that set Orthodox jews apart in terms of disadvantages:
1. Higher rates of 'anti-semitism'
2. The strict geographic 'Sabbath' law (must be walking distance to synagogues and kosher facilities)
3. Extremely large family sizes (average 7 children)
4. 'Disproportionately high levels of poverty and socio-economic disadvantage'
- June 2019: The mother's legal team argued this was de-facto 'positive discrimination' but the Court of Appeal upheld the High Court's decision.
- 2020: she appealed to the UK Supreme Court which issued a unanimous judgment dismissing it. The court ruled that AIHA is legally protected by charity exemptions and 'positive action clauses' within the Equality Act 2010.
- 2020/2021: the mother took her case to the European Court of Human Rights (ECHR) in Strasbourg.
- June 2022: the ECHR rejected the application.
This set the binding legal precedent.
Critics and housing advocates were outraged.
AIHA is heavily funded by the public's taxes and heavily subsidised by the state's tax breaks through two mechanisms:
1. Direct and indirect government funding:
• To purchase land, build new estates, and redevelop old properties.
• Through local council budgets (Housing Benefit or Universal Credit) paid to residents, which makes up the majority of AIHA's operational income.
2. Charity tax exemptions:
• Zero corporation tax on the surpluses (profits) from rent or investment income.
• At least an 80% discount on business rates (local property taxes).
• Zero property purchase tax when buying land or houses (Stamp duty land tax relief).
AIHA remains the only publicly funded social housing provider in the UK actively enforcing a strict, 100% religious restriction.
AIHA's legal team was Asserson Law Offices founded in 2005 to allow British-trained jewish lawyers to move to 'israel' while continuing to practise UK law at the highest levels. Their largest office is in 'Tel Aviv'.
The lead solicitor was Elliot Lister. A British jew from Manchester who moved with his family to occupy Palestine in 2006.
