Revised Order on Utilisation of Earned Non-Admin Operating Expenditure by Distribution Companies
The Nigerian Electricity Regulatory Commission (NERC) has issued a revised Order on the utilisation of earned Non-Administrative Operating Expenditure (Non-Admin OpEx) by successor electricity Distribution Companies (DisCos).
This Order is aimed at accelerating network upgrades, improving service reliability, and ensuring that available revenues are invested in critical infrastructure projects.
The Order, which takes effect from September 4, 2026, follows a regulatory review of DisCos' revenue utilisation for the 2025 market cycle.
Key Highlights of the Order are:
DisCos must establish and maintain dedicated Capital Expenditure (CapEx) Provision Accounts to fund approved network improvement projects.
A portion of earned Non-Admin OpEx will be earmarked for network rehabilitation, reinforcement, and expansion, based on each DisCo's debt profile.
Debt-free DisCos are required to remit 50% of earned Non-Admin OpEx to the CapEx account from August 2026, increasing to 60% from February 2027.
All projects funded through the CapEx Provision Account must receive NERC approval and be reported quarterly.
DisCos owing NBET and the Market Operator must complete debt reconciliation and submit Commission-approved repayment plans within 180 days.
This Order is designed to strengthen distribution infrastructure, improve service delivery, and enhance financial discipline in the electricity sector.

The Nigerian Electricity Regulatory Commission is aware that some Distribution Companies (DisCos) have instructed customers to apply and pay for the replacement of faulty and obsolete meters within their franchise areas. This instruction contravenes the Commission’s Order No. NERC/246/2021 on the Structured Replacement of Faulty and Obsolete end-use Customer Meters in the Nigerian Electricity Supply Industry.
The Order clearly states that no customer with a meter should be forcefully migrated to estimated billing. If any customer’s meter is adjudged by any DisCo to be obsolete or faulty, it is the responsibility of the DisCo to replace the meter free of charge, provided that the fault was not caused by the customer.
The Commission restates its commitment to protect customers’ interests and rights by ensuring compliance with established regulatory standards and enforcing regulatory penalties for non-compliance by its licensees.

NERC Monitors Electricity Complaints Resolution In Lokoja
The Nigerian Electricity Regulatory Commission (NERC) is monitoring an ongoing customer complaints resolution session in Lokoja, Kogi State.
Over 300 customers of the Abuja Electricity Distribution Company (AEDC) are coming to submit their complaints and have them resolved on the spot by a team of AEDC customer care officials.
Among the AEDC customers that were attended to was Victor Atule who had purchased a prepaid meter from the AEDC Lokoja office but could not recharge on the platform.
“That has been an issue for the past week but when I came today, they gave me two codes and said I should load it along with my token to activate the meter. I am very happy for the instant response,” said Atule.
Mrs Fatima Oveto, a Lokoja resident complained of the billing system saying people should not be made to pay the same estimated bill of N25,000 which is too high. “The customer care people have explained the tariff system to me and that it was approved by NERC. They said they will work on it and see what Band my community is in.”
Chief Yakubu Godwin, leader of Iga Community in Olamaboro LGA of Kogi state said his community has been out of power for years and wants that rectified. He was satisfied with the process as he was asked to attach a letter of connection to his complaints for AEDC to process.
Alhaji Abubakar Akowe submitted a complaint on behalf of Jama’atul Nasril Islam on their application for a meter in April 2023. “In the NERC evaluation form, I commended NERC for helping to resolve this issue because I have been assured that a meter has been assigned and will be installed today,” he said.
Honourable Ocheni Matthew, a landlord said he had filed a complaint to AEDC in 2022 about a meter bypass in his property which he was told to pay a N500,000 fine.
“I contested the penalty because we suspected that the bypass was done in collusion with AEDC officials by my tenant who had died thereafter.”
Ocheni said after another meeting, AEDC agreed to remove N100,000 from the fine and that he would have to pay the N400,000 fine. Upon submitting this same complaint at the complaint session on Friday, Ocheni was directed by the AEDC customer care to appeal the case at the NERC Lokoja Forum Office if he was not satisfied with the previous resolution.
Most of the AEDC customers were grateful that their complaints including applying and getting a prepaid meter installed in their premises were resolved the same day during the three-day session.

NERC, NOA INVITE KOGI ELECTRICITY CONSUMERS FOR MEETING, COMPLAINT RESOLUTION
The Nigerian Electricity Regulatory Commission (NERC) on Wednesday partnered with the National Orientation Agency (NOA) to mobilise electricity consumers in Kogi ahead of a town hall meeting and customer complaints resolution forum in Lokoja, the state capital.
While the town hall meeting is slated for Thursday 12th September 2024, the customer complaint resolution continues till Saturday 14th September 2024.
Moving around the streets of Lokoja, from the GRA through key business hubs to the Kwata market, electricity consumers and customers of the Abuja Electricity Distribution Company (AEDC) were sensitised about the importance of attending the event.
Officials of the NOA Kogi State Directorate and those of NERC spoke to the electricity consumers using English and local languages – Igala, Ebira, Hausa, Nupe, among others while sharing fliers of the event to passersby.
The NOA Kogi state Director Abdulganiyu Dare, represented by the Assistant Director and Head of Programmes, Augustine Ogbonnikan while addressing the press stated that the event presents electricity consumers with the opportunity to file their complaints and have them resolved on the spot by a dedicated team from AEDC.
According to the Customer Enlightenment Manager of the Consumer Affairs Division of NERC, Ishaya Bassi, the participants will be also sensitised about the rights and obligations of electricity customers serviced by AEDC in line with the NERC Customer Protection Regulations 2023 (CPR).
Also in attendance are Mrs Kemi Iyanda, Interim Secretary of NERC for Kwara and Kogi offices and her team, AEDC officials from the Lokoja office and NOA programme officers.
