This is simple not true.

Before June 2015 COCH’s NN mortality rate was below average. It then spiked for 13 months because of a spike in acuity, not because of a spike in staffing issues. Pervasive staffing issues similar to those across the NHS may have exacerbated the impact of a spike in acuity, but it was a spike in acuity that was the driving factor, not a spike in staffing issues. There WAS no spike in staffing issues.

"The reality of the Thirlwall Inquiry is that it has been conducted on the premise that an innocent woman is guilty of crimes she has not committed."

In a public statement, Lucy Letby's barrister Mark McDonald says the imminent Thirlwall report may be "significantly undermined" if the former nurse's convictions are eventually overturned.

"I would strongly urge the government to pause on any recommendation until the evidence now gathered has been considered by the Court of Appeal."

I have just completed another nearly 2-hour interview with Prof. Christopher Fitzpatrick, the first part of which will be released tomorrow. This is my 64th recorded interview for my Lucy Letby Analysis channel (although there are a couple with new guests that I have yet to release).

Back in September 2025, one of my early guests was Prof. David Livermore. Prof. Livermore. joined the Health Protection Agency (now Public Health England), becoming Director of its Antibiotic Resistance Monitoring and Reference Laboratory in 1998. In October 2011, he became Professor of Medical Microbiology at UEA.

Prof. Livermore has sat on the British Society for Antimicrobial Chemotherapy working parties on resistance surveillance, multi-resistant pathogens and susceptibility testing and its Antibiotic Action advisory board, also on the Society for General Microbiology working group on sexually transmitted infections. He has also been a member of the UK Government’s Antimicrobial Resistance and Healthcare Associated Infections Advisory Committee and has contributed extensively to the Chief Medical Offer for England’s  Annual Report for 2011.

He has published and speaks widely on resistance and has edited for several journals including Journal of Antimicrobial Chemotherapy and Journal of Medical Microbiology and, currently, International Journal of Antimicrobial Agents.

Some memorable quotes from my interview with Prof. Livermore are as follows:

“As I listened to Shoo Lee’s teleconference, it’s just a catalogue of poor management...this is a catalogue of bad care.”

“Infection was such an obvious cause of a spike in deaths. What investigation did they do? I’ve yet to see any clarity on this.”

“They are primarily responsible for running the unit, and they have been running something which was microbiologically unsafe.”

“Evans ruled out everything other than Lucy Letby. He ruled out poor care. He ruled out mistakes on the unit. He ruled out infection. He just ruled out everything other than Lucy.”

“So much has now been done by so many people from so many different angles that the unsafeness - the questionability - of these convictions is really crystal clear.”

I will mention finally that there will be some new microbiology content on the channel soon, as I have been contacted by another microbiologist who has provided pages of notes, which I haven’t had time to convert into a video(s) yet!

I have added the below to the briefing document section "The trial". Thank you to the legally qualified person who alerted me to this.

During jury deliberation, on 24 July 2023, Goss received a question from the jury:

“Can you, please, clarify how long it would take for a baby’s insulin to C-peptide ration (sic) to return to normal the manufactured insulin had stopped?”

Goss told them:

The answer is there was no evidence at all on that particular topic. What there was -- and, of course, there was an insulin to C-peptide ratio that was derived from analysis of the blood sample which was sent off to the laboratory in the case of two babies who had these abnormal readings. The results came back after each baby had recovered, whichwas days later.

What there was, was the evidence from Professor Hindmarsh as to how long it takes for normal blood sugar readings to return to normal once insulin had stopped. That is what the evidence was and that is what I reminded you of. There was nothing about Cpeptides. All it was, was that those were very abnormal findings indicating that manufactured insulin had undoubtedly been given to each of these babies. I hope that addresses the question.

I have highlighted the key sentence and within that the key word, "undoubtedly". [Highlights are in the blog post not in this X post].

By using the word “undoubtedly”Judge Goss made a statement of fact. In law, this is not permitted. It is the role of the jury to make determinations of fact. The role of the judge is to make determinations of law.

This distinction is very clear in law. The judge is not permitted in to usurp the role of the jury.

This is reflected in case law precedent in R v Wang [2005] , R v Hayes; R v Palambo [2025], R v Adams [1994].

As the insulin evidence has now been shown to be far from “undoubtedly” a fact, the judge's direction constitutes a ‘material misdirection’ and grounds for appeal.

During the 9 indictment months there were four days when there were five IC cots occupied: the three in the chart which pertained to Babies G, O, and P and one other (28 June 2016 which was four days after Baby P died). I don't know where they put the fifth IC cot.

Here's another chart. The seven indictment deaths occurred in the four (of nine) busiest months. Not only that but the most deaths (3) occurred in the busiest month, second most (2) in the second busiest month, and the the third most (1 in each of two months) in the third and fourth busiest months. It's quite extraordinary.
