WHAT SHOULD A TENANCY AGREEMENT CONTAIN?

Before you sign anything, read everything.

Many tenants sign tenancy agreements without reading them.

Some cannot even find their copy after moving in.

This is how people lose money, lose cases, and lose sleep.

A good tenancy agreement should contain the following:

1. Names and addresses of both parties

The full name of the landlord and the tenant must be clearly stated. If an agent is involved, their details should also appear.

2. Description of the property

The full address of the property being rented. This sounds obvious, but some agreements are vague here.

3. Duration of the tenancy

Is it a monthly, yearly, or fixed-term tenancy? The start date and end date must be clear.

4. Rent amount and payment terms

How much is the rent? When is it due? How should it be paid - cash, transfer, cheque? These must all be spelled out.

5. Caution/security deposit

How much was paid as deposit? Under what conditions will it be refunded? A good agreement answers this clearly.

6. Responsibilities of the tenant

Who pays for minor repairs? What can the tenant not do on the property - subletting, running a business, keeping pets?

7. Responsibilities of the landlord

Who handles major repairs? How much notice must the landlord give before entering the property?

8. Termination and notice period

How much notice must either party give before ending the tenancy? One month? Three months? This protects both sides.

9. Conditions for rent review

Can the landlord increase rent? By how much and how often? A fair agreement addresses this upfront.

10. Dispute resolution

What happens if there is a disagreement? Is there a process for resolving it before going to court?

11. Signatures of both parties

An agreement without signatures is just a document. Both parties must sign and date it. A witness signature adds extra protection.

A tenancy agreement is not a formality. It is a legal document that protects you when things go wrong, and things do go wrong.

If you are not sure what you are signing, ask a lawyer before you sign. Not after.

Manny people think that once a land is verified and fully paid for, ownership is secured. That is not always true. In land matters, payment alone is not enough, possession is key.

✅Fence your land and put a gate if possible. If money is tight, a dwarf fence or even just the pillars is enough to show ownership. You can also allow someone to farm on the land with your permission. Once land is in use, trespassers are discouraged.

✅Visit your land regularly, at least once every three months. An unattended land is easy to encroach on. Make sure neighbours know you as the owner and have your phone number so they can alert you if anything happens.

✅Also, secure your documents properly. Do not rely only on receipts or allocation letters. Ensure you have a Registered Survey and a Deed of Assignment, and process your Certificate of Occupancy where required.

✅Putting up a “Not for Sale” sign also helps warn land grabbers.

If you cannot do anything at all on your land, understand this truth: that land is not safe.
