A sugar baby who receives money, gifts, travel, housing and other financial benefits in exchange for companionship, sexual services or any other thing of value is not receiving gifts under Maldives tax law.

These amounts constitute taxable income and are chargeable to income tax, under Section 3(m) of the Income Tax Act

Section 3 of the Income Tax Act lists the types of income subject to tax (subject only to the specific exemptions in Section 12). The residual provision in Section 3(m) states “Income or gains of any other kind, including monies and assets received for no consideration and as proceeds of any criminal or illegal activity, unexplained monies (whether or not recorded in the books of accounts), unexplained investments and expenditures, and unexplained assets”.

True gifts (transfers for no consideration) fall within this catch all and are taxable unless they qualify for the limited gift exemptions in Section 12(o):

🔹Gifts received by an individual up to a maximum of MVR 40,000 per accounting period.

🔹Gifts from a related person, certain wedding gifts or grants from gov or an approved charitable organisation.

When money, housing, travel and other benefits are provided in exchange for companionship, sexual services or any other value, there is consideration. The receipt is therefore not a gift. It’s income derived in return for something of value.

As such:

🔹It doesn’t qualify for any gift exemption under Section 12.

🔹It’s taxable either as business income under Section 3(b) (Income derived from any business) if the activity has the characteristics of a business or profession or under the residual “income or gains of any other kind” in Section 3(m).

In either case the amounts form part of the recipient’s taxable income and are subject to the progressive individual rates (0 % on the first 720,000 MVR of taxable income, rising to 15 %). Non cash benefits are valued and included.

The Act does not require the underlying activity to be legal or formally organised for the receipts to be taxable.

There is no exemption or special rule that re characterises quid pro quo payments in a sugar baby arrangement as non taxable gifts.

Kaizeen has to pay tax. Her bank statements, spending, assets can be used to do a proper MIRA tax assessment. She’s been avoiding tax for years.
