Ottawa cannot legally tax Alberta oil and gas exports.

Ted Morton and former Supreme Court Justice Jack Major just shredded last week’s Herald column that claimed Mark Carney can unilaterally slap an “exit tax” on our energy to fight Trump.

s. 109: the resources belong to the provinces.

s. 125: you cannot tax provincial property.

Canadian courts have already ruled that s. 125 beats the federal trade-and-tax power.

This is the NEP all over again. Pierre Trudeau tried the exact same export tax. Peter Lougheed called it “tantamount to a declaration of war,” took it to court, and won. Alberta Court of Appeal 1981.

Supreme Court 1982: “Section 125 raised to the rank of constitutional guarantee the immunity of provincial property from taxation.”

Lougheed then used the win to force s. 92A into the Constitution so it could never happen again.

Ontario (122) + Quebec (78) have the seats to ignore us — the same math that gave Trudeau a majority in 1980 with zero Western MPs.

If Carney chooses politics over the Constitution, he will supercharge the October 19 referendum. Morton and Major say he should know that.

Morton is a former Alberta energy and finance minister who taught constitutional law for 23 years.

Major sat on the Supreme Court and was the lawyer who argued the 1981 case for Alberta.
