The ironic thing about Dickson and the NDC is that they started this wahala by heading to court and shopping for a favourable judge all the way to Lokoja.
INEC has the constitutional responsibility of vetting and registering political parties. In this instance, it rejected the NDC’s application on the ground of logo infringement.
NDC then approached the court and obtained an order compelling INEC to register the party despite the issue with its logo.
However, an interested party later informed the same court that it had been excluded from the proceedings, even though its rights were directly affected. Upon reviewing the circumstances, the judge set aside the earlier order compelling INEC to register the party.
The questions, therefore, are these:
Why didn’t NDC simply change the logo and return to INEC to complete the registration process? Why seek to use the court process to bypass an administrative requirement in the first place?
Secondly, can a court review and set aside its own order? Yes, in certain circumstances, particularly where an interested party was not joined or there was a fundamental procedural defect.
And here lies the irony: when the court initially ordered registration, the judge was celebrated and the judiciary was hailed as the last bastion of hope. Now that the same judge has acknowledged a procedural error and corrected it, he is suddenly being portrayed as “ BAT Government Agent “
That selective outrage is the very definition of hypocrisy.
On the face of it, I do not see that NDC has an easy path in this case.
