The fight against live digital piracy relies on the co-operation of Internet intermediaries to react immediately to notices from copyright holders to takedown infringing content and to blocking orders from national regulatory bodies. It is precisely because of the lack of such co-operation that mechanisms such as the Italian content protection system have been introduced to ensure that content is removed in a timely fashion.

The Open Internet and Free Speech are being used as smokescreens by non-complying actors to justify their inaction. While intermediaries complain about fines running into the millions of dollars, the sustainability of the audiovisual industry is at risk of being systematically deprived of millions in revenues because pirated content is not being removed immediately.

The European Commission has recognised in its recent Assessment on piracy that online intermediaries are not reacting to content removal in the way required by the Digital Services Act (DSA). Industry bodies, such as the @SportsRightsOC, are therefore working with the Commission to make the DSA’s content removal mechanisms legally enforceable. The Open Internet and Free Speech are not synonymous with theft, and the Rule of Law will prevail when conducting business in the EU.
