Frustrated by the Tamil Nadu government's ongoing inability to remove encroachers from the ecologically sensitive Agasthyamalai landscape, the Supreme Court has emphasized the need for a structured, time-bound, and closely monitored framework. A Bench comprising Justices Vikram Nath and Sandeep Mehta highlighted that despite directives from both the Madras High Court and the top court, encroachments in protected areas like the Kalakad Mundanthurai Tiger Reserve (KMTR), Srivilliputhur-Megamalai Tiger Reserve (SMTR), and Kanyakumari Wildlife Sanctuary have persisted for decades. The court even went so far as to suggest deploying the paramilitary to clear the encroachers.
Key Highlights from the Central Empowered Committee (CEC) Report:
💥 Extensive Encroachments: Based on a court-ordered survey, the CEC found massive unauthorized occupation of reserved forest land, including 427.40 hectares in the Kanyakumari Wildlife Sanctuary and substantial encroachment in KMTR involving 10.16 hectares by 998 families.
💥 Ecological Vulnerability: The Srivilliputhur-Megamalai Tiger Reserve was noted as particularly vulnerable because it forms the upper catchment of the Vaigai River, a critical water source for five downstream districts.
💥Government Servants Involved: Alarmed by the official findings, 118 individuals identified as encroachers are currently serving or retired government employees, including personnel from the Army, Police, Forest, and other State departments. Additionally, 116 government and public utility structures were built inside forest lands without prior approval.
State Response and Strict Supreme 💥Court Directions:
While the State filed a detailed affidavit acknowledging the challenges—such as ongoing court cases, resistance from encroachers, and the fact that many are landless and economically weaker sections—the Supreme Court maintained that the complexity of rehabilitation cannot be a perpetual justification for postponing evictions.
The apex court has issued strict directives to address the crisis:
💥 Disciplinary Actions: Initiate disciplinary and legal action against all 118 identified government servants found to be encroachers.
💥 Denial of Infrastructure Support: Impose a blanket moratorium on extending welfare schemes, public utilities, transport facilities, electricity supply, and infrastructure support within encroached forest areas.
💥 Ban on New Activities: Enforce a complete prohibition on approving or commencing any new non-forestry activity within the Agasthyamalai landscape.
