2023 ஆம் ஆண்டு தொழிற்சாலைகள் (தமிழ்நாடு திருத்தச்) சட்டம் ஒன்றை இன்று தமிழ்நாடு அரசு தோழமை கட்சிகளின் எதிர்ப்புக்குமிடையில் நிறைவேற்றியிருக்கிறது. இது திமுக இத்தனை ஆண்டுக் காலமாகக் கடைபிடித்து வரும் தொழிலாளர் நலன்சார்ந்த கொள்கைளுக்கே எதிராக உள்ளது. அத்துடன்,
உலகமே கொண்டாடும்
மே நாளுக்கான அடிப்படையே தொழிலாளர்களின் வேலைநேரம் எட்டு மணி நேரம் என்பதேயாகும். அத்தகைய வரலாற்றுச் சிறப்புக்குரிய, தொழிலாளர்களின் குருதியில் விளைந்த வெற்றிக்கான உயரிய அடையாளமாக விளங்கும் எட்டு மணிநேர வேலை என்னும் உரிமையைப் பறிக்கும் வகையில்,
பனிரெண்டு மணி நேரமாக உயர்த்துவது உழைக்கும் தொழிலாளர் வர்க்கத்திற்கு எதிரான நடவடிக்கையே ஆகும். முதலாளித்துவ ஆதிக்கத்திற்கு மேலும் வலு சேர்ப்பதாக அமையும். அத்துடன், இச்சட்டத்தால் தொழிலாளர் சமூகம் கூடுதலான உழைப்புச் சுரண்டலுக்கு ஆட்பட்டு கடும் பாதிப்புக்கு உள்ளாகும். இதனால் தமிழ்நாடு அரசின் மீதான நம்பகத்தன்மைக்குப் பாதிப்பு உண்டாகும். எனவே, இதனை உடனடியாகத் திரும்பப்பெற வேண்டுமென தமிழ்நாடு அரசை விடுதலைச் சிறுத்தைகள் கட்சியின் சார்பில் வலியுறுத்துகிறோம்.

தமிழ்நாடு அரசு நிறைவேற்றியுள்ள இந்த சட்டம், 1948 ஆம் ஆண்டு தொழிற்சாலைகள் சட்டத்தின் பிரிவு 51, 52, 54, 55, 56 மற்றும் 59 ஆகியவற்றின் வகைமுறைகள் அல்லது அதன்கீழ் செய்யப்பட்ட விதிகள் ஆகியவற்றுக்கு குறிப்பிட்ட காலத்துக்கு விலக்கு அளிக்க வகை செய்கிறது. இதன்மூலம் வேலை நேரத்தைத் தொழிலகங்கள் விரும்புகிறபடி மாற்றி அமைத்துக்கொள்ள இது அதிகாரமளிக்கிறது. இதனால் தற்போதுள்ள 8 மணி நேர வேலை என்பது 12 மணி நேரமாக உயரும் ஆபத்து உள்ளதாக தொழிலாளர்கள் அஞ்சுகின்றனர்.

தொழிலாளர்கள் 8 மணி நேரம் வேலை என்கிற உரிமையைப் பெற்ற போராட்டத்தின் நினைவாகத்தான் மே மாதம் 1 ஆம் தேதி மே தினம் என்று உலகெங்கும் கொண்டாடப்படுகிறது. இந்தியாவிலேயே முதன்முதலாகத் தமிழ்நாட்டில்தான் நூறு ஆண்டுகளுக்கு முன்பு 1923 இல் சிங்காரவேலரின் முன் முயற்சியால் மே நாள் கொண்டாடப்பட்டது. அதன் நூற்றாண்டு கொண்டாடப்படும் இந்த நேரத்தில் வேலை நேரத்தை 8 மணி நேரத்தில் இருந்து 12 மணி நேரமாக உயர்த்தி இருப்பது மிகுந்த வேதனை அளிக்கிறது.

இந்த சட்ட மசோதா அறிமுகப்படுத்தப்பட்ட போது திராவிட முன்னேற்றக் கழகத்தின் தோழமைக் கட்சிகளான இடதுசாரி கட்சிகளும் விசிகவும் இதை சட்டமாக்க வேண்டாம் என்று கூறினோம். அதனையும்
மீறி இன்று இந்த சட்டம் நிறைவேற்றப்பட்டிருக்கிறது. இந்த சட்டம் நிறைவேற்றப்பட்டபோது விசிக உறுப்பினர்களும் இடதுசாரி கட்சிகளின் உறுப்பினர்களும் சட்டப்பேரவையில் இருந்து வெளிநடப்புச் செய்து தங்களின் எதிர்ப்பையும் பதிவு செய்துள்ளனர்.

இந்தியாவிலேயே இல்லாத அளவுக்கு மக்கள் பாராட்டும் விதத்தில் பல்வேறு நலத்திட்டங்களை செயல்படுத்தி மக்களின் பேராதரவைப் பெற்றிருக்கும் திமுக அரசு, பாஜகவே நடைமுறைப்படுத்தத் தயங்கிவரும் இந்த சட்டத்தை எதற்காக நிறைவேற்றினார்கள் என்பது புரியாத புதிராக உள்ளது.

2020ஆம் ஆண்டு தொழிலகப் பாதுகாப்பு, சுகாதாரம் மற்றும் பணி நிலைமைகள் தொகுப்பு (மையச் சட்டம்) சட்டமானது, நாடாளுமன்றத்தில் இந்திய ஒன்றிய அரசால் நிறைவேற்றப்பட்ட போது திமுக,விசிக, இடதுசாரிக் கட்சிகளின் உறுப்பினர்கள் கடுமையான எதிர்ப்பைத் தெரிவித்தனர். அந்த எதிர்ப்பின் காரணமாக இன்னும் கூட அந்த சட்டத்தை ஒன்றிய பாஜக அரசு செயல்படுத்த முன்வரவில்லை. பாஜக அரசே செயல்படுத்தாத இந்த சட்டத்தைத் தமிழ்நாட்டில் செயல்படுத்துவதற்கு எந்தத் தேவையும் இல்லை.

தொழிலாளர்களின் உரிமையைப் பறிக்கிற மக்கள் விரோத சட்டமான இந்த திருத்தச் சட்டத்தை உடனடியாகத் திரும்பப் பெற வேண்டும் என்று மாண்புமிகு முதலமைச்சர் அவர்களை விடுதலைச் சிறுத்தைகள் கட்சியின் சார்பில் வலியுறுத்திக் கேட்டுக் கொள்கிறோம்.
