The US Constitution, Section 8, says Congress has the power “to coin Money, regulate the Value thereof …”
It doesn’t say anyone can create alt currencies to use as legal tender in the US. I suspect SEC Chair, Gensler, may rely on this when kicking crypto legislation to Congress
