Sometimes people charged with 2nd degree murder are in fact in on what's about to happen. But sometimes, especially in the 70s and 80s, they were not.
I've talked to old lifers who have been in prison for decades despite never actually killing anyone.
Police investigate. We both get charged -- I with 1st degree murder and you with 2nd degree murder. You didn't actually kill anyone. You didn't know I was going to either. But it doesn't matter; you were an accessory.
Both have the same mandatory sentence: Life without parole.
You're fumbling with your keys to start the car when I come running out after you. I scream at you to drive. You don't know what's going on and you're scared of what I might do, so you drive.
Later, you find out that I killed the cashier and you drove the getaway car.
As we're waiting in line to pay, I turn to you and I say, "Watch this." I pull out a gun you didn't know I had and I proceed to threaten the cashier. You, who did not know I had the gun, didn't know any of this was going to happen, run outside and get in your car.
