A counterclaim is an independent action.

Just as a claimant must support his claim with evidence, a defendant must prove his counterclaim. A defence to the counterclaim must also be supported by evidence.

Where a party files a defence to a counterclaim but fails to file a witness statement on oath or otherwise lead evidence in support of that defence, the defence may be treated as abandoned.

A defendant can amend his statement of defence to introduce a counterclaim.

A counterclaim is a separate action brought by the defendant within the plaintiff’s suit. The Court should not refuse the application merely because allowing it may require the plaintiff to respond or recall witnesses.

The proper consideration is the justice of the case, not the convenience of the plaintiff.

From the decision of the Supreme Court in Adamu v. State (2026) 12 NWLR (Pt. 2055) 419. It appears that the Court is of the opinion that where it is proved by the prosecution that it was the act of the accused that led to the death of the deceased but from the Record, the the NATURE OF A WEAPON OF ATTACK is/was missing, and there is nothing else suggesting that the accused intended to cause the death of the deceased, or even cause grievous bodily harm, the Court will infer that the accused did not intend to kill the deceased.

In this case, Mr Sagir ADAMU's appeal to the Supreme Court after he was convicted and sentenced to death by the Court of Appeal was commuted to a term of imprisonment for twenty years.

Dear clients and potential clients, please do not wait for “lawyers to resume” before bringing a court process to your lawyer.

The courts may be on annual vacation, but lawyers have not gone on vacation. More importantly, some courts remain open as Vacation Courts, and urgent matters can still be attended to.

If you are served with a process, send it to your lawyer immediately. Do not assume that nothing can be done because the courts are on vacation. Some deadlines continue to run, and some matters require prompt action.

The only thing on vacation is the court. Your lawyer is still very much at work.

The events that led to the ruling of Hon. Justice S.I Okpara of the High Court of Imo state is deeply troubling.

The 10-page ruling should leave the bench and bar equally concerned and interested in unravelling how exactly a judgment delivered in the open court was different from what was certified as the true copy in substance.

Determining whether an action is statute barred is a matter of calculation.

The Court looks at when the cause of action arose and when the action was filed. It then calculates the period between both dates.

There is no discretion to extend or reduce the limitation period simply because the Court considers it fair to do so.

The calculation must be precise because once the prescribed period expires, the right to enforce the cause of action is lost.

In your formative stage, leave woman alone. I beg of you. There are so many women in this world that you will get tired.

Focus.

Don’t excessively chase any woman with your sweat and scarce resources . If you are lucky to find one that loves you sincerely, settle down quickly and build together so you can focus.

When building, two heads are better than one.

In Oguche v. State (2026) 5 NWLR (Pt. 2037) 457, the Supreme Court made an important observation on legal representation. The Court held that where a party has been given every opportunity to present his case, the manner in which such party counsel conducts the case is generally a matter of professional choice and does not, by itself, amount to a denial of fair hearing which can be used a ground of Appeal.

This judgment is a reminder that clients must be intentional about who they engage as their lawyer whether for the purpose of litigation or other legal services. You don't want to gamble with your legal need. You may be wondering why some big men pay huge millions as professional fees to lawyers. The reason is not far-fetched. It's simply because they cannot afford to take unnecesary risk.

Having a good case is one thing; having competent counsel who can properly present that case is another. A client may have a strong case on the facts and law, but the quality of legal representation can significantly affect how that case is presented and ultimately determined. This is why people should be deliberate about engaging competent and qualified legal practitioners when they have a matter to litigate
